These Terms and Conditions have been drawn up in accordance with current legislation on the subject, including Royal Decree 1/2007 of November 16, approving the revised text of the Ley General para la Defensa de los Consumidores y Usuarios and other complementary laws, as well as Law 34/2002, on Servicios de la Sociedad de la Información y la Ley , and Law 59/2003, of December 19, on Firma Electrónica.
The general terms and conditions, as well as any other specific terms and conditions of purchase that may apply to the purchase of products and services offered on https://enoturismo.vinosdelaluz.com/ , shall always be those in force at the time each order is placed.
LA LUZ DEL DUERO SL may modify these general terms and conditions of purchase at any time, while respecting any commitments previously made to its customers. Such modifications will be published on the website itself so that new customers may be aware of them.

3.1. Products.
The website will display the products for sale at all times, along with their characteristics and retail price in each of its sections.
Wines or any other product containing alcohol will only be sold to persons of legal drinking age, who must declare their age when placing an order.
LA LUZ DEL DUERO SL decides which products to offer its customers through the website at any given time.
In this way, LA LUZ DEL DUERO SL may add references to the catalog of products offered on the website https://enoturismo.vinosdelaluz.com/, or remove them, respecting in any case orders placed previously or the duration of specific campaigns or offers that it had already committed to.
In accordance with current legislation, the sale or service of alcoholic beverages to minors through this website is prohibited.
3.2. Price indication
The prices of the products available for purchase are listed in euros and include the Impuesto Sobre el Valor Añadido (IVA).
3.3. Payment methods
Payments may be made by credit or debit card through the Redsys payment gateway.
The Redsys Virtual Payment Terminal (VPT) accepts payments with American Express, Master Card, Maestro, Visa and Visa Electron cards. To make card payments, you must provide: card number, expiry date, cardholder’s first and last names (as they appear on the card) and the card’s CVV code.
The amount of the order will be charged to the customer’s bank card at the time of purchase.
To improve protection against possible fraud, customers must re-enter their card details for each purchase, as LA LUZ DEL DUERO SL does not have access to or store its customers’ bank details.
LA LUZ DEL DUERO SL undertakes not to allow any transaction that is illegal, or considered as such, and may or has the potential to cause harm. The sale or offer of a product or service that is not in full compliance with all laws applicable to the Buyer, Issuing Bank, Merchant, Cardholder, or cards is prohibited.
3.4. Availability
LA LUZ DEL DUERO SL will only deliver orders within Spain (mainland and Balearic Islands).
During the processing of the order itself, if the purchased product is not available, the customer will be notified electronically, by email or telephone, of its unavailability, and we will attempt to find a solution or alternative to the order placed by the customer.
3.5. Shipping costs
Shipping costs shall be paid together with the order amount and will be itemised on the invoice. Shipping costs shall be free of charge for orders to mainland Spain and the Balearic Islands.
3.6. Order confirmation
The customer shall confirm the order by clicking on the “Continue” button during the payment process. Once confirmed, the order is final and binding, will be automatically registered, and LA LUZ DEL DUERO SL will proceed with its delivery.
The automatic registration of the order placed serves as proof of its nature, content and date. Confirmation of the order by the customer implies acceptance of the prices, description of the products offered, delivery costs and other conditions of sale of the product, which are set out in this document. Once the purchase process is complete, the system will confirm the order placed via the website to the customer. This confirmation will also be sent to the email address provided during registration.
The order confirmation and proof of purchase (printed by the user) shall not be valid as an invoice.

3.8. Order delivery times
As indicated above, LA LUZ DEL DUERO SL, through its website, https://enoturismo.vinosdelaluz.com/, it does not serve all of Spain, only the mainland and the Balearic Islands.
Orders will be delivered to the address provided by the customer when placing the order within 72 working hours (excluding Saturdays, Sundays and public holidays), although this period may vary depending on product availability or the delivery address. If the customer is not at the delivery address at the time of delivery, a notice will be left with instructions on how to contact the transport agency to arrange a new delivery. Several delivery attempts may be made on consecutive days, after which the order will be returned to LA LUZ DEL DUERO S.L.. After this period, if the customer claims their order, they will have to pay the shipping costs again.

Failing this, the order will be delivered to the person of legal age who is present at the address indicated at the time of delivery. The customer expressly authorises LA LUZ DEL DUERO SL to deliver the order on their behalf. The recipient of the order must sign the corresponding delivery note, providing their name and ID number or similar, which implies their acceptance of the products received, both in terms of quantity and quality and the condition in which they are found.
To this end, the recipient may check the order as many times as they wish upon receipt in order to show their agreement with it. If it is incomplete, they must expressly state this on the corresponding delivery note.
3.9. Accreditation of operations
The acceptance of the order by LA LUZ DEL DUERO SL, as well as information relating to any transaction made using the corresponding order number and other documentation generated, will be stored and archived, serving as evidence in the event of a dispute.
4. Return of products
4.1. Right of withdrawal
The Customer shall have a maximum period of fourteen (14) calendar days from delivery of the product to withdraw, in whole or in part, from the purchase of the product, in accordance with applicable legislation.
Notwithstanding the foregoing, and in accordance with the provisions of Article 102.1 and 2 of the Real Decreto Legislativo 1/2007, of 16 November, approving the revised text of the Ley General for the Defensa de los Consumidores y Usuarios, and other complementary laws, the right of withdrawal may not be exercised on bottles that have been opened, nor, in the case of products delivered in wooden boxes, when these have been opened or unsealed. Nor may the right of withdrawal be exercised in the case of personalized products.
Once the period of fourteen (14) calendar days has expired, LA LUZ DEL DUERO SL will not accept returns due to withdrawal from product purchases.
In the event of cancelling the purchase of a product, the Customer must contact LA LUZ DEL DUERO SL by sending an email to tienda@vinosdelaluz.com or by telephone +34 983 878 007.
In any case, if you decide to cancel the purchase, the following requirements must be met:
· The product must be in the same condition as when it was delivered and must retain its original packaging and labelling.
· Returns to LA LUZ DEL DUERO S.L. must be made using the same box used for delivery, or, failing that, in a similar format that guarantees the return of the products in perfect condition (except in the case of wine bottles served in wooden boxes, which can only be returned in the same unopened box).
To exercise your right of withdrawal, it is not sufficient to physically return the product; you must first notify us that you are exercising your right of withdrawal by means of a communication. This communication must be sent to the email address tienda@vinosdelaluz.com, by physical delivery with proof of the date of receipt at the address indicated above, always within the aforementioned period of 14 calendar days. • In the event of withdrawal, the refund will include all shipping costs paid by the customer when making the purchase. However, LA LUZ DEL DUERO SL may charge additional shipping costs in the event of an unusual shipping method or express delivery.
• In any case, in the event of withdrawal, the customer shall be responsible for paying the costs of returning the products to LA LUZ DEL DUERO SL.
4.2. Return of defective products
Without prejudice to any other rights that may apply, the Customer shall be entitled to a refund of the price of defective products or products delivered that do not correspond to the order placed by the user. Alternatively, the user shall be entitled to claim and receive a product identical to the one requested, in perfect condition.
• In the event of returning defective products or products that do not correspond to the order placed to LA LUZ DEL DUERO SL, the return must be made by the Customer using the procedure established in section (4.1) above, although in this case the Customer shall not be responsible for the costs of returning said products.
• Provided that the User has followed the procedure set out in section (4.1) above and the requirements set out in this section have been met, LA LUZ DEL DUERO SL will refund the price paid for the returned products that are defective or do not correspond to the order placed by the Customer, in accordance with the provisions of section (4.3) below.
4.3. Refund of the price of the products
• Provided that the Customer has followed the procedure set out in this section and the requirements set out therein have been met, LA LUZ DEL DUERO SL will refund the price paid by the Customer for the returned products and the shipping costs, except in the case of an unusual shipping method or express delivery. In the event that the return is made in exercise of the User’s right of withdrawal described in section (4.1), LA LUZ DEL DUERO SL will not pay or bear the costs and/or expenses of returning the product to LA LUZ DEL DUERO SL.
The Customer shall not be entitled to a refund for returned products that are not in the same condition in which they were delivered, or that do not meet the requirements set out in these General Terms and Conditions.
Partial returns of an order will result in a refund of the price corresponding to the product or products actually returned.
LA LUZ DEL DUERO S.L. will process the refund using the same payment method used by the Customer to purchase the products, within fourteen (14) days of collecting the returned order, and once LA LUZ DEL DUERO SL has verified that the returned products meet the requirements set out in sections (4.1) and (4.2) above. The application of the refund to the Customer’s account will depend on the bank.

7. Applicable legislation. Submission to jurisdiction
This contract shall be governed by Spanish law, which shall apply in matters not covered by this contract in relation to interpretation, validity and enforcement. Any disputes arising from the purchase of products through this website shall be submitted to the competent courts and tribunals determined by law.
